Jakarta - Public Relation: The Policy of Supreme Court on electronic case administration in court that created an application namely e-court provided the ease from both service and cost to public to process their cases in court. Definitely this application can be called as realization of the principle of the administration of justice, they were ease, rapid, and low cost.

That statement stated by Secretary of Supreme Court A.S Pudjoharsoyo, SH., M.Hum, in front of the candidate of E-court  trainer in Training of E-Court Trainers Application on September, 4 2018 in Bekasi, West Java.

One of the ease that E-court given according to Pudjoharsoyo were ease to fill  the cases “The one who lives in Jakarta, in case he/she has cases in Jayapura, they don’t need to come to Jayapura to fill the case, but they can fill it electronically from Jakarta.” Pudjoharsoyo pointed out.

Pudjoharsoyo Added that this condition will totally different with the previous court. Where the citizen must come from far area with no information how to process it. And after that, they must meet the people who offer the services, both from inside or outside the court. Pudhoharsoyo gives an example the previous trial such as “Ticket Trial” which filled with oknum (unscrupulous members) of Ticket Cases. “Eventually, they have offered me when I out of the car, They don’t know that I definitely was Head of the Court”. Said the former of Head of Jakarta Barat District Court.

Meanwhile, after electronic filing, the summon to attend the trial also applied electronically both to defendant and plaintiff who accepted the electronic summon. Even to those who are outside the jurisdiction of the court, is enough to be carried out electronically and the court in charge of the residence of the party is sufficiently given a copy. “It will be faster and cheaper than the conventional way which is later and more expensive.” Pudjoharsoyo Stated.

THE DEMAND OF GLOBAL COMMUNITY

On the sidelines of the event, Pudjoharsoyo said that e-court application is demand of global community. This was proven by World Bank on Ease of Doing Business in Indonesia which one of the indicators are the availability of the rapid and precise mechanism of business enforcing contracts and the availability mechanism of resolving insolvency.

“The E-Court is to support the Ease of Doing Business.” Pudjoharsoyo Added.

Besides indicated of ease, rapid, and low cost as stated above, the ease of doing business also seen in Deadline of Delivering the Decision to the Party. In the Article 17 Paragraph (2) Supreme Court Decree Number 3 of 2018 stated that especially in bankruptcy cases/ The company filed a debt postponement petition (PKPU), the copy of verdict/decision of court sent to parties no later than 7 days since the decision is read.

CONSIDERED TO JUDICIAL APPARATUS’ READINESS

Trough frame of e-court as stated above, judicial apparatus must be ready with the kind of changing that Supreme Court bring out. The readiness according to Pudjoharsoyo can be made with two ways, they were:

The first way, says pudjoharsoyo is always be positive to the changing existed. He uses an example E-SKUM which he encouraged when He became Head of Pekanbaru District Court. “The kind of minor response, such as those who called E-SKUm as es teller (Such as a cup of ice with variety of fruit), indeed it is totally counterproductive with the step of change occure”. He pointed out.

According to Pudjoharsoyo the second way is well understanding that e-court is the way to give the excellent service to public, especially to user registered.
