THE SUPREME COURT IMPLEMENTS VIRTUAL JUDICIAL TECHNICAL UPGRADING AND ADMINISTRATION

Palembang – Public Relations: Amid the covid-19 Supreme Court of the Republic of Indonesia implements virtual judicial technical upgrading and administration for the second time on Wednesday, November 11, 2020. This time the event which was still implemented in strict health protocol held at Wyndham Hotel Palembang. The participants of this session are chief judges, vice chief judges, judges, registrars, and secretaries of First Court and Appellate Court in Indonesia.

In the remarks, Chief Justice of the Supreme Court Dr. H. M. Syarifuddin, S.H., M.H, says that due to the Supreme Court's commitment to electronic and digitalize kind of assignments, the Supreme Court's best generation has successfully created SPPT-TI (Information Technology-based Integrated Criminal Justice System). Through this system, the Supreme Court expects that the Court still be the leading sector among other law enforcers. Besides, the Supreme Court also prepares special SIPP (Information Tracking System) development which includes kinds of features such as post-bankruptcy decision.  It also develops decision directory feature with adding chamber plenary drafting, rule of law, landmark decision, jurisprudence, restatement, and legislation, as well as updating search engine that allows filtering of referenced keywords and also document source parameters, verdict, classification, year of registration and court decisions, it is easier for users because the search results displayed becomes more specific.

At the same time, the Chief Justice emphasizes that giving legal and justice service and judicial upgrading not only done by information technology utilization but also it can be done with maximizing the role of Appellate Court as voorpost or front liner of the Supreme Court in judicial apparatus upgrading and controlling.

To support maximizing the role and function of Appellate Court as a front liner, then to all leaders, judges as well as officials in Appellate Court to develop the capacity especially in controlling field.

According to Syarifuddin, we need to also educate the public and judicial apparatus in the first court that report and complaint on judicial apparatus can be finished faster and more responsive by Appellate Court. The true concept of the court is a place to get justice not to play justice. If the judiciary consistently appears as an institution that only gives justice, then public trust in court will be undoubtedly and the dignity of the court and its apparatus will be honored. 

The former Chief of Supervision Chamber says that nowadays one of the issues that seize public intention is Law Number 11 of  2020 Omnibus Law on Job Creation that was promulgated on November 2nd, 2020. He says that he sees many material law changes that may occur with the enactment of this omnibus law, especially in the fields of environmental law, licensing, patents, labor, land, and other branches of law. Therefore, judges are required to quickly understand and master this law, so that they can decide on disputes related to the Omnibus Law by still prioritizing the principle of justice.

Performance allowances for judicial apparatus as referred to in Presidential Regulation Number 8 of 2020 on Employee Performance Allowances in the Supreme Court and its Subordinate Judicial Bodies, which is then followed up by Supreme Court Regulation Number 3 of 2020 on Implementation of Providing Employee Performance Allowances within the Supreme Court and Its Subordinate Judicial Bodies, have been able to be paid and can be enjoyed by judicial apparatus throughout Indonesia.

Furthermore, Syarifuddin says it is necessary to carry out adequate monitoring and supervision to measure performance and the level of discipline. During this pandemic, we indeed need to divide work between work from an office (WFO) and work from home (WFH) solely to limit the accumulation of the number of apparatus in the same place at one time, making it difficult for physical and social distancing. However, it must be reminded that WFH actually does not mean a vacation or leave from work, but rather working from home. Therefore, WFH should not be misinterpreted and misused by being filled with activities that do not support the work of the institution, moreover filled with activities that have the potential to spread the Covid-19 virus.

At the end of his remarks, The Chief Justice bear in mind to all judicial apparatus to always keep health with strictly followed new normal adaption and obeying the 3 M health protocol, namely: washing hands, using masks and physical distance. Discipline in adhering to health protocols will protect us and those around us. Stay safe and always pray to Allah SWT. so that we all stay healthy and the Covid-19 pandemic can end soon.

This technical upgrading is also attended by Justices, Ad-hoc Justices, Official Echelon 1 and  2 of the Supreme Court as well as Chief Judges of Appellate Court throughout Palembang.
