THE SUPREME COURT MAKES AN EFFORT IN DRAFTING THE CRIMINAL GUIDANCE TROUGH THE SUPREME COURT REGULATION NUMBER 1 OF 2020

Jakarta-Public Relation: Supreme Court of Republic of Indonesia cooperates with USAID CEGAH held a webinar on Application Supreme Court’s Regulation Number 1 of 2020 on Criminal Guidance article 2 and 3 Law of Corruption. The virtual workshop held on Thursday April, 29th 2021.

Chief Justice of the Supreme Court, Dr. H. M. Syarifuddin, S.H., M.H., said in his speech that the Supreme Court struggles in drafting criminal guidelines. One of them is the formation Working Group of the Corruption Crime Criminal Guidelines, based on the Decree of the Chief Justice of the Supreme Court of the Republic of Indonesia Number 189/KMA/SK/IX/2018.

Criminal Guidelines Working Group was finally able to assist the issuance of Supreme Court Regulation No.1 of 2020 on Criminal Guidelines for Articles 2 and 3 of the Corruption Eradication Law, which has been in effect since the date of its promulgation, namely on July 24, 2020. This successful was great efforts and the support from many parties.

The former Chairman of the Supervisory Chamber stated that during the period of 9 months, PERMA No. 1/2020 had been implemented by judges in determining the severity of the crimes imposed for corruption convicts. "Of course there are benefits that are felt as a result of the presence of this criminalization guideline PERMA, both benefits for judges in the form of ease of compiling variables that affect punishment, as well as benefits for reducing disparity itself." Said Dr. Syarifuddin.

Besides, PERMA Number 1 of 2020 was born with the premise that imposing penalties must be carried out with due regard to the proportionality of the punishment without neglecting legal certainty. In addition, this PERMA was also born as an effort to provide a benchmark that makes it easier for judges, especially in law enforcement, in the form of determining the severity of punishment, based on comprehensive considerations of state losses, level of error, impact, benefits and range of punishment, as well as matters of things that lighten and burdensome.

Dr. Syarifuddin welcomed this workshop as an opportunity to exchange experiences, as well as a medium for evaluative reflection on the process of reviewing, drafting, to the process of socializing and implementing the PERMA of this criminal code. Including a means of reflection for him who was previously entrusted with leading the Working Group on the Guidelines for Corruption Crime.
